1. Scope

These Terms of Service govern the use of the mobile app “Catchy” and the “Catchy Pro” subscription offered within it, operated by:

2. Conclusion of contract

The Pro subscription is concluded via the Google Play Store. The contract is between you and Daniel Reichhart / Digitalma. Google Play acts as the payment processor. The subscription auto-renews until you cancel via your Google Play account.

3. Scope of services

Catchy is a carp-fishing app that provides a science-based “score” between 0 and 100 as a recommendation for fishing conditions. The score is informational only and does not guarantee fishing success.

Pro unlocks additional features (7-day hourly forecast, all 10 score factors in detail, manual factor adjustment, spot comparison, full logbook history). The exact feature scope may expand or change over time.

4. Pricing

Pro Monthly: €4.99 (or country-specific equivalent).
Pro Annual: €22.99 (or country-specific equivalent).

All prices include 20 % Austrian VAT (or the VAT applicable in the buyer’s country, processed by Google Play).

5. Right of withdrawal

The separate withdrawal policy at getcatchy.app/widerrufsrecht applies. For digital content, the right of withdrawal expires once performance has started — see the policy.

6. Cancellation

Cancel the Pro subscription anytime via the Google Play Store. The subscription ends at the end of the paid period.

7. Liability

Catchy assumes no liability for:

  • Lost fish or absence of catches
  • Score prediction errors
  • Incorrect weather data from third-party APIs (Open-Meteo)
  • Accidents or property damage while fishing

While fishing, only the legal safety / conservation rules of your country / region apply. Following them is your responsibility.

For other damages, Daniel Reichhart is liable only for intent and gross negligence, to the extent permitted by law.

8. Data protection

The separate Privacy Policy applies.

9. Governing law / jurisdiction

Austrian law applies, excluding the UN Sales Convention. For consumers, mandatory consumer protection law of their country of residence remains unaffected. Place of jurisdiction for businesses is Linz; for consumers, statutory venues apply.

10. Changes to these Terms

We may update these Terms. Material changes will be announced in the app at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

Allgemeine Geschäftsbedingungen

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für die Nutzung der Mobile-App „Catchy“ und das darin angebotene „Catchy Pro“-Abonnement, betrieben von:

2. Vertragsschluss

Das Pro-Abonnement wird über den Google Play Store abgeschlossen. Vertragspartner sind du und Daniel Reichhart / Digitalma. Google Play agiert als Zahlungsabwickler. Das Abo verlängert sich automatisch bis zur Kündigung über deinen Google-Play-Account.

3. Leistungsumfang

Catchy ist eine Karpfenangel-App, die einen wissenschaftlich basierten „Score“ zwischen 0 und 100 als Empfehlung für Angelbedingungen liefert. Der Score ist eine reine Information und keine Garantie für Fangerfolge.

Pro-Abo schaltet zusätzliche Funktionen frei (Stunden-Forecast über 7 Tage, alle 10 Score-Faktoren detailliert, manuelle Faktoren-Anpassung, Spot-Vergleich, alle Sessions im Logbuch sichtbar). Der konkrete Funktionsumfang kann sich im Lauf der Zeit erweitern oder ändern.

4. Preise

Pro Monatlich: 4,99 € (oder länderspezifischer Equivalent).
Pro Jährlich: 22,99 € (oder länderspezifischer Equivalent).

Alle Preise inklusive 20 % österreichischer Umsatzsteuer (bzw. der im Land des Käufers gültigen MwSt., abgewickelt von Google Play).

5. Widerrufsrecht

Es gilt die separate Widerrufsbelehrung. Für digitale Inhalte erlischt das Widerrufsrecht mit Beginn der Leistungserbringung — siehe Belehrung.

6. Kündigung

Kündigung des Pro-Abos jederzeit über den Google Play Store. Das Abo endet zum Ende des bezahlten Zeitraums.

7. Haftung

Catchy übernimmt keine Haftung für:

  • Fangverluste oder ausbleibende Fänge
  • Fehlprognosen des Scores
  • Falsche Wetterdaten von Drittanbieter-APIs (Open-Meteo)
  • Unfälle oder Sachschäden beim Angeln

Beim Angeln gelten ausschließlich die gesetzlichen Sicherheits- und Naturschutzbestimmungen deines Landes / Bundeslandes. Das Befolgen ist deine Verantwortung.

Bei sonstigen Schäden haftet Daniel Reichhart nur für Vorsatz und grobe Fahrlässigkeit, soweit gesetzlich zulässig.

8. Datenschutz

Es gilt die separate Datenschutzerklärung.

9. Anwendbares Recht / Gerichtsstand

Es gilt österreichisches Recht unter Ausschluss des UN-Kaufrechts. Bei Verbrauchern bleibt zwingendes Verbraucherschutzrecht des Wohnsitzlandes unberührt. Gerichtsstand für Unternehmer ist Linz; für Verbraucher gelten die gesetzlichen Gerichtsstände.

10. Änderungen der AGB

Wir können diese AGB anpassen. Material-Änderungen werden mindestens 30 Tage vor Inkrafttreten in der App angekündigt. Mit weiterer Nutzung nach Inkrafttreten gelten die neuen AGB als angenommen.

2. Conclusion du contrat

L'abonnement Pro est conclu via le Google Play Store. Le contrat est conclu entre vous et Daniel Reichhart / Digitalma. Google Play agit comme processeur de paiement. L'abonnement se renouvelle automatiquement jusqu'à votre résiliation via votre compte Google Play.

3. Étendue des services

Catchy est une appli de pêche à la carpe qui fournit un « score » à base scientifique entre 0 et 100 comme recommandation pour les conditions de pêche. Le score est purement informatif et ne garantit pas un succès de pêche.

Pro déverrouille des fonctionnalités supplémentaires (prévision horaire sur 7 jours, détail des 10 facteurs du score, ajustement manuel des facteurs, comparaison des postes, historique complet du carnet). L'étendue précise des fonctionnalités peut évoluer ou changer avec le temps.

4. Tarifs

Pro mensuel : 4,99 € (ou équivalent par pays).
Pro annuel : 22,99 € (ou équivalent par pays).

Tous les prix incluent 20 % de TVA autrichienne (ou la TVA applicable dans le pays de l'acheteur, gérée par Google Play).

5. Droit de rétractation

La Politique de rétractation séparée s'applique sur getcatchy.app/widerrufsrecht. Pour le contenu numérique, le droit de rétractation s'éteint dès le début de l'exécution — voir la politique.

6. Résiliation

Résiliez l'abonnement Pro à tout moment via le Google Play Store. L'abonnement prend fin à la fin de la période payée.

7. Responsabilité

Catchy n'assume aucune responsabilité pour :

  • Les prises manquées ou l'absence de prises
  • Les erreurs de prévision du score
  • Des données météo erronées provenant d'API tierces (Open-Meteo)
  • Les accidents ou dommages matériels lors de la pêche

Lors de la pêche, seules les règles légales de sécurité et de protection de la nature de votre pays ou région s'appliquent. Leur respect est de votre responsabilité.

Pour les autres dommages, Daniel Reichhart n'est responsable qu'en cas de faute intentionnelle ou de négligence grave, dans la mesure permise par la loi.

8. Protection des données

La Politique de confidentialité séparée s'applique.

9. Droit applicable / juridiction

Le droit autrichien s'applique, à l'exclusion de la Convention des Nations Unies sur les contrats de vente internationale de marchandises. Pour les consommateurs, le droit impératif de protection des consommateurs de leur pays de résidence reste applicable. La juridiction compétente pour les entreprises est Linz ; pour les consommateurs, les juridictions légales s'appliquent.

10. Modifications des CGU

Nous pouvons mettre à jour ces CGU. Les modifications substantielles seront annoncées dans l'appli au moins 30 jours avant leur entrée en vigueur. L'utilisation continue après la date d'effet vaut acceptation.
